NXT Sports USA Terms and Conditions

These Terms and Conditions govern access to and use of NXT Sports USA websites, registration and account tools, tournament and league services, communications, and related offerings. By creating an account, registering a team or player, making a payment, attending or participating in an NXT event, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Important: Participation in athletic activities involves separate safety risks and legal terms. Any participant waiver, release of liability, medical authorization, media authorization, tournament rule, or event-specific policy presented during registration is incorporated into these Terms. If an event-specific document conflicts with these general Terms, the event-specific document controls for that subject.
1 Definitions
“NXT,” “we,” “us,” and “our” mean NXT Sports USA and its authorized operators. “Services” means our websites, software, registration platform, tournaments, leagues, scheduling, standings, communications, and related offerings. “User” means any visitor, account holder, team manager, coach, parent, guardian, participant, or other person using the Services. “Participant” means a player, coach, manager, official, volunteer, or attendee involved in an NXT program or event.
2 Eligibility and authority
You must be at least 18 years old and legally able to enter into a contract to create an account, register a team or minor, accept a waiver, or make a payment. If you act for a team, organization, parent, guardian, or participant, you represent that you have authority to provide information, accept applicable terms, and make commitments on that person’s or organization’s behalf. Minors may use participant-facing features only through, or with the authorization and supervision of, a parent or legal guardian.
3 Accounts and account security
You must provide accurate, current, and complete information and keep it updated. You are responsible for protecting your login credentials and for activity under your account. Do not share credentials with unauthorized persons or create an account using another person’s identity. Notify us promptly at info@nxtsportsusa.com if you suspect unauthorized access. We may verify account ownership, manager status, parental authority, or other submitted information before granting or restoring access.
Team managers are responsible for managing authorized coaches and roster invitations. Administrative impersonation or account-assistance features may be used by authorized NXT personnel to troubleshoot, support users, correct records, or administer an event. Access through those features will be limited to legitimate business purposes and handled under our Privacy Policy.
4 Registration and rosters
A registration is not guaranteed until NXT accepts it and all required information, agreements, and payments are completed. Capacity limits, division placement, eligibility rules, and waitlist status may apply. NXT may accept, reject, reclassify, waitlist, transfer, or cancel a registration when reasonably necessary to protect competitive balance, safety, event operations, or compliance with published rules.
Managers, parents, and guardians must submit accurate player, roster, emergency-contact, and eligibility information. Players may not participate until required waivers and authorizations have been completed. Rosters may lock on the date stated for the event or season. Guest players, substitutions, or transfers are allowed only when expressly permitted by the applicable rules. NXT may request age, identity, residency, insurance, or roster documentation and may disqualify a team or participant for false or incomplete information.
5 Fees payments credits and taxes
Prices, deposits, gate fees, processing fees, sanction fees, installment terms, deadlines, and included services are shown during registration or in the applicable event materials. You authorize NXT and its payment processor to charge the payment method you select for amounts you approve, including any agreed installment or remaining balance. Payment processing may be provided by a third party whose terms also apply.
Account credits have no cash value, are nontransferable unless NXT approves otherwise, and may be subject to stated expiration or event restrictions. Credits are applied according to the checkout terms shown to you. You are responsible for applicable taxes and for keeping payment information current. A failed, reversed, or disputed payment may result in suspension, cancellation, collection activity, or withholding of schedules, standings, awards, or future registration access, to the extent permitted by law.
Before initiating a chargeback, contact info@nxtsportsusa.com so we can review the transaction. Nothing in these Terms limits your rights under applicable payment-card or consumer-protection laws.
6 Cancellations refunds transfers and event changes
The refund, credit, cancellation, and transfer policy displayed for the applicable event or season is part of these Terms. Unless that policy states otherwise, registration and processing fees become nonrefundable once NXT has reserved capacity, committed facilities or officials, created schedules, or incurred event costs. A team’s withdrawal, inability to field a roster, scheduling conflict, travel issue, or rule violation does not automatically create a right to a refund.
NXT may change dates, times, locations, fields, formats, divisions, opponents, game lengths, schedules, or rules because of weather, field conditions, safety concerns, participation levels, government action, facility restrictions, or circumstances outside NXT’s reasonable control. When an event is shortened, relocated, postponed, or canceled, any refund or credit will be determined under the posted event policy and applicable law. NXT is not responsible for travel, lodging, equipment, lost work, or other indirect expenses.
7 Event rules conduct and enforcement
All Users and Participants must follow posted rules, facility rules, eligibility standards, safety instructions, and directions from authorized NXT personnel and officials. Prohibited conduct includes threats, harassment, discrimination, fighting, abusive language, fraud, cheating, roster manipulation, unauthorized field access, property damage, unlawful activity, and conduct that threatens safety or materially disrupts an event.
NXT may warn, remove, suspend, disqualify, forfeit, or ban a User, Participant, team, or spectator for violating these Terms or event rules. Decisions involving immediate safety or event administration may be made on site. Any appeal process stated in the applicable rules must be followed. Removal or discipline for misconduct does not entitle the affected person or team to a refund.
8 Scheduling scores standings and statistics
Schedules, brackets, scores, standings, seeds, records, and statistics may change because of corrections, protests, eligibility rulings, weather, forfeits, or administrative error. Users should rely on the latest information published through the Services or communicated by NXT. NXT may correct obvious errors and apply published tiebreakers and run-differential rules. Platform displays are informational and do not override a final ruling by authorized event staff.
9 Health safety and assumption of risk
Baseball, softball, football, soccer, training, and related activities involve inherent risks, including contact with people or equipment, thrown or batted balls, collisions, falls, weather exposure, facility conditions, illness, serious injury, disability, and death. Participation may require acceptance of a separate waiver and release. You are responsible for determining whether you or a minor in your care is medically and physically able to participate and for following emergency, concussion, heat, weather, and return-to-play instructions.
NXT does not provide medical advice and does not guarantee the availability of medical personnel. In an emergency, NXT or facility personnel may contact emergency services and use the emergency information supplied during registration. The parent, guardian, or adult Participant remains responsible for medical costs except where applicable law provides otherwise.
10 Communications and consent
By providing an email address or mobile number, you agree that NXT may send transactional or relationship communications concerning accounts, registrations, payments, rosters, schedules, event changes, safety, and customer support. These communications are part of providing the Services and may continue where legally permitted even if you opt out of marketing.
If you separately consent to marketing or promotional messages, NXT may send them by email or text using automated technology. Consent to marketing is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to a marketing text to opt out and HELP for help, or use the unsubscribe method in a marketing email. NXT will honor valid opt-out requests as required by law. Carriers are not liable for delayed or undelivered messages. Keep your contact information current and do not provide a number or address you are not authorized to use.
11 User content and permissions
Users may submit team names, logos, rosters, photos, videos, messages, scores, and other content. You retain ownership of content you own. You grant NXT a nonexclusive, worldwide, royalty-free license to host, store, reproduce, format, display, and distribute that content only as reasonably necessary to operate, secure, improve, and promote the Services, subject to applicable privacy choices and media authorizations. You represent that you have the rights and permissions needed to submit the content, including permission relating to minors where required.
Do not submit unlawful, infringing, deceptive, defamatory, threatening, sexually explicit, malicious, or privacy-invasive content. NXT may remove or restrict content that violates these Terms or creates legal, safety, or operational risk.
12 NXT intellectual property
The Services, including NXT Sports USA names and logos, software, designs, page layouts, graphics, event materials, schedules as compiled, and original content, are owned by or licensed to NXT and are protected by intellectual-property laws. Except as expressly permitted, you may not copy, scrape, modify, reverse engineer, sell, sublicense, create derivative works from, or commercially exploit the Services. You may use schedules and event information for your team’s ordinary noncommercial participation purposes.
13 Acceptable use and platform integrity
You may not interfere with the Services; bypass access controls; probe or exploit vulnerabilities; introduce malware; automate access in a manner that burdens the platform; harvest personal information; impersonate another person; access records without authorization; or use the Services to send spam or unlawful communications. NXT may investigate suspected misuse, preserve relevant records, limit access, and cooperate with lawful requests.
14 Third party services and links
The Services may integrate with payment processors, email and text providers, mapping tools, scoring platforms, social networks, and other third parties. Third-party services are governed by their own terms and privacy practices. NXT is not responsible for third-party services, outages, content, security, or acts, but this provision does not limit responsibility that cannot legally be excluded.
15 Privacy
Our collection, use, retention, and disclosure of personal information are described in the NXT Sports USA Privacy Policy, which is incorporated into these Terms. Parents and guardians should not permit a child under 13 to create an independent account or directly submit personal information. Information about minors should be provided only by an authorized adult through the designated registration and roster process.
16 Suspension termination and service changes
NXT may suspend or terminate access, remove content, cancel registrations, or stop offering any part of the Services when reasonably necessary for security, legal compliance, nonpayment, misuse, safety, or violation of these Terms. Where practical, NXT will provide notice and an opportunity to address the issue. Provisions that by their nature should continue after termination remain effective, including payment obligations, intellectual-property provisions, disclaimers, liability limits, indemnity, and dispute terms.
17 Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” NXT DOES NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR AVAILABLE AT A PARTICULAR TIME, OR THAT ANY EVENT WILL INCLUDE A PARTICULAR NUMBER OF GAMES, OPPONENTS, FIELDS, OFFICIALS, OR AMENITIES EXCEPT AS EXPRESSLY STATED IN A WRITTEN EVENT POLICY. NXT DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT TO THE EXTENT SUCH WARRANTIES MAY LEGALLY BE DISCLAIMED.
Nothing in these Terms excludes any warranty, duty, or remedy that cannot be excluded under applicable law.
18 Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NXT AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, VOLUNTEERS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOST OPPORTUNITY, TRAVEL COSTS, OR BUSINESS INTERRUPTION ARISING FROM THE SERVICES OR AN EVENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NXT’S TOTAL LIABILITY ARISING FROM A CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT THE CLAIMANT PAID NXT FOR THE SPECIFIC REGISTRATION OR SERVICE GIVING RISE TO THE CLAIM DURING THE 12 MONTHS BEFORE THE EVENT CREATING LIABILITY OR (B) $100. THESE LIMITS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED BY LAW, INCLUDING LIABILITY TO THE EXTENT CAUSED BY NXT’S FRAUD, WILLFUL MISCONDUCT, OR GROSS NEGLIGENCE WHERE SUCH EXCLUSION IS PROHIBITED.
19 Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless NXT and its owners, officers, employees, contractors, volunteers, and agents from third-party claims, losses, liabilities, damages, and reasonable costs arising from your unlawful conduct, your material violation of these Terms, content you submit, or your lack of authority to act for a team or another person. This obligation does not require you to indemnify any party for that party’s own negligence, gross negligence, willful misconduct, or other liability that may not legally be shifted to you.
20 Disputes governing law and venue
Before filing a lawsuit, you and NXT agree to make a good-faith effort to resolve the dispute informally. Send a written notice describing the issue and requested resolution to info@nxtsportsusa.com. NXT will use the contact information associated with your account for notices to you. Either party may seek immediate relief where necessary to protect safety, confidential information, or intellectual-property rights.
These Terms are governed by California law, without regard to conflict-of-law rules. Unless applicable law requires another location, any lawsuit arising from these Terms or the Services must be filed in the state or federal courts serving Riverside County, California, and each party consents to personal jurisdiction there. Either party may bring an eligible matter in small claims court. This section does not waive any nonwaivable consumer right or legally required venue.
21 Changes to these Terms
NXT may update these Terms to reflect changes in the Services, law, or business practices. The updated version will state a new effective date and will be posted through the Services. If a change materially affects existing Users, NXT will provide additional notice when required by law. Changes apply prospectively. Continued use after the effective date of updated Terms constitutes acceptance, except where applicable law requires affirmative consent.
22 General terms
These Terms, the Privacy Policy, applicable registration terms, event rules, and accepted waivers form the agreement between you and NXT concerning the Services. If any provision is held unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will continue. NXT’s failure to enforce a provision is not a waiver. You may not assign your rights or obligations without NXT’s written consent; NXT may assign these Terms as part of a merger, reorganization, sale, or transfer of the relevant business or assets. Headings are for convenience only. Electronic acceptance and records have the same effect as paper records and signatures to the extent permitted by law.
